Terms of Service

Welcome to AIFirstIndex (the “Service”). These Terms of Service (“Terms”) are a binding agreement between you and AIFirstIndex (“we”, “us”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

AIFirstIndex provides free, adaptive diagnostic tests for standardized exams (currently the Digital SAT). The Service identifies potential concept gaps and presents a “Weakness Index” report. It is a study aid, not a tutoring service, exam, or certification.

2. AI-Generated Content (Important)

All practice questions, answer choices, explanations, and related educational content on the Service are generated using artificial intelligence (AI). The content is produced by automated systems and is provided on an “as is” and “as available” basis for general educational and self-assessment purposes only.

Because the content is AI-generated, it may occasionally contain errors, inaccuracies, or ambiguities, and it may not reflect the exact format, difficulty, or scoring of any official examination. We make no representation that any question is error-free or that any answer is definitively correct. By using the Service, you acknowledge and accept that the content is AI-generated and agree that you will not rely on it as authoritative, professional, or official test material. You use the content at your own discretion and risk.

3. No Guarantee of Results

Diagnostic results, accuracy percentages, and any estimated score ranges are approximate indicators based on short question sets. They are not predictions of, and do not guarantee, your actual examination score, academic performance, or admissions outcome.

4. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose;
  • scrape, harvest, copy, resell, or redistribute the questions, explanations, or reports;
  • attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service;
  • misrepresent the Service or its content as official examination material.

5. Intellectual Property

The Service, its design, and its AI-generated content are owned by or licensed to us and are protected by applicable law. SAT® is a trademark registered by the College Board, which is not affiliated with, and does not endorse, this Service. Any third-party trademarks are the property of their respective owners and are used for identification only.

6. No Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ITS CONTENT.

8. Advertising

The Service is supported by advertising, including Google AdSense. Your use of the Service is also subject to our Privacy Policy.

9. Governing Law

These Terms are governed by the laws of the United States and the state in which the operator is established, without regard to conflict-of-laws principles. You agree that any dispute will be resolved in the courts located there.

10. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
